When Does Permission Start If a Renewal or Change of Status Is Approved Before the Expiration Date?

Extension of period of stay and change of status of residence are both important immigration procedures in Japan. However, the practical meaning of permission granted before the current expiration date is not the same.

After filing an application for extension of period of stay or an application for change of status of residence, permission may be granted before the expiration date of the current period of stay.

In that situation, applicants and employers often ask questions such as:

  • If renewal is approved early, will the remaining period of stay be lost?
  • If change of status is approved before the expiration date, does the new status start from that day?
  • How should the start date of employment and the residence card be checked?

What Is an Extension of Period of Stay?

The Immigration Services Agency of Japan explains that an application for extension of period of stay is filed when a foreign national wishes to continue staying in Japan beyond the granted period of stay without changing the current status of residence.

In other words, renewal is a procedure to extend the period of stay while maintaining the same status of residence.

Therefore, even if renewal permission is granted before the current expiration date, it is generally not understood as meaning that the remaining period is automatically lost. In practice, the new period is often understood as continuing from the day after the current expiration date.

Example:
If the current expiration date is July 31, 2026, and renewal permission is granted on June 20, 2026, the new period of stay is generally understood as continuing from August 1, 2026.

What Is a Change of Status of Residence?

By contrast, an application for change of status of residence is a procedure used when a foreign national intends to change the activity in Japan and engage in activities that fall under a different status of residence.

Typical examples include changing from Student to Engineer/Specialist in Humanities/International Services, or changing from Dependent to a work-related status of residence.

A change of status is not merely an extension under the same status. It is a switch to a different status of residence. Therefore, the legal position before and after permission may be different. If the planned start date of work, employment contract, graduation date, resignation date, or other timing issue is involved, careful confirmation is necessary.

Before change of status permission is granted, the person should not assume that activities under the new status are already allowed. When employment or a new activity is involved, the timing of permission and the residence card details should be checked carefully.

Difference From the Special Period While an Application Is Pending

Sometimes, an application for extension or change of status is still pending when the current period of stay expires.

The Immigration Services Agency explains that, when a person holding a residence card files an application for extension of period of stay or change of status of residence and no decision is made by the expiration date, the person may continue to stay in Japan and engage in the previous activities under the previous status until either the decision is made or two months have passed from the expiration date, whichever comes first.

However, this special pending-application period is a separate issue from the start date when permission is granted before the expiration date. Filing an application, waiting under the special period, receiving permission, and obtaining the new residence card should be understood separately.

  • Do not rely only on the notice of permission; check the status of residence, period of stay, and expiration date on the residence card.
  • If employment, job change, resignation, graduation, divorce, or other change of circumstances is involved, individual review may be necessary.

  • Do not confuse the special period while an application is pending with the start date after permission is granted.
